Terms of Service

By accessing or using InkTwist, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the service.

These terms, together with our Privacy Policy, govern your use of InkTwist and form the agreement between you and us. We encourage you to read both before using the service.

InkTwist is intended for adults. You must be at least 18 years old to use the service. By using InkTwist, you represent that you are 18 or older and that you are legally able to enter into a binding agreement with us. If you don’t meet these requirements, you may not use the service.

You create an InkTwist account by signing in with your Google or Apple account. InkTwist doesn’t store passwords; access to your InkTwist account is controlled entirely through the Google or Apple account you sign in with, so keeping that account secure is your responsibility.

You’re responsible for all activity that happens under your InkTwist account. If you suspect someone has accessed your account without your permission, let us know as soon as you can at hello@inktwist.ai.

InkTwist is meant for telling stories, reading, and learning languages. To keep it that way for everyone, when you use the service you agree not to:

• Attempt to break, probe, or overload the service, including scraping, automated access, or circumventing rate limits or other technical protections.
• Use story inputs or any other feature to generate unlawful content, or any content that exploits or harms minors.
• Harass or abuse other people through the service.
• Resell the service, or misrepresent it or your relationship to it (for example, by claiming to be InkTwist or acting on our behalf).
• Interfere with anyone else’s use of the service.

If you violate this section, we may remove the content involved or restrict your account.

Story text, translations, and other content on InkTwist are generated by artificial intelligence. AI output can contain errors, inaccuracies, or invented details, and it may include statements or themes that don’t reflect InkTwist’s views. InkTwist is a learning aid and an entertainment product, not an authoritative language reference. If a translation or explanation matters to you (for an exam, a document, a conversation that counts), verify it with an independent source.

You keep whatever rights you have in the things you write into InkTwist, such as the actions and dialogue you type for your character. To the extent InkTwist holds any rights in AI-generated story output produced from your inputs, we grant you a license to use that output for personal, non-commercial purposes.

Because AI models can produce similar results for similar inputs, other users may receive output that resembles yours, and we can’t promise that any generated content is unique or exclusive to you.

InkTwist and its licensors own the service and everything that makes it up: the software, design, branding, and the InkTwist name, as well as the handcrafted story worlds we author, including their settings, premises, and characters. All of this is protected by copyright, trademark, and other intellectual property laws.

We grant you a limited, personal, non-exclusive, non-transferable, revocable license to access and use the service as it’s intended to be used: playing stories, learning languages, and reading within the app. This license doesn’t give you ownership of anything: nothing in these terms transfers any of InkTwist’s intellectual property to you, and you may not copy, sell, or redistribute our story worlds or other materials outside the service. (Ownership of AI-generated story output and your own inputs is covered in the “AI-generated content” section.)

If you send us feedback, suggestions, or ideas about the service, you agree that we may use them freely, without payment, attribution, or any other obligation to you.

You’re free to stop using InkTwist at any time. If you’d like your account deleted, email us at hello@inktwist.ai and we’ll take care of it.

We may suspend or terminate your account if you violate these terms, if your use of the service creates risk or possible legal exposure for us or others, or if we discontinue InkTwist or part of it. Where reasonably possible we’ll give you notice first, but we may act without notice when it’s reasonably necessary (for example, to protect the service or other users).

When your account is terminated, your license to use InkTwist ends. Any sections of these terms that by their nature should survive termination (including those covering intellectual property, disclaimers, limitations of liability, and governing law) will continue to apply.

InkTwist is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. The service is under active development: we don’t guarantee that it will be uninterrupted, secure, or error-free, that any content (including AI-generated stories, translations, and other output) will be accurate or reliable, or that defects will be corrected. Features may change, be suspended, or be withdrawn at any time without notice.

Some jurisdictions don’t allow the exclusion of certain warranties, so some of the exclusions above may not apply to you. In that case, they apply to the fullest extent permitted by law.

To the maximum extent permitted by law, InkTwist and the people who build and operate it will not be liable to you for any damages of any kind arising out of or relating to your use of the service or your inability to use it — whether direct, indirect, incidental, special, consequential, or punitive, and including any loss of data, profits, or goodwill. This applies whatever the legal theory behind the claim (contract, tort, statute, or anything else), and even if we’ve been told such damages were possible.

To the extent the exclusion above is not permitted where you live, our total combined liability for all claims relating to the service is capped, to the maximum extent permitted there, at the greater of the amount you paid InkTwist in the twelve months before the claim arose and USD $50.

Nothing in these terms excludes, restricts, or modifies any right or remedy that cannot lawfully be excluded, restricted, or modified, including the consumer guarantees under the Australian Consumer Law. Where such a law applies, our liability is limited to the fullest extent it permits — for example, where permitted for services, to resupplying the services or paying the cost of having them resupplied.

These terms are governed by the laws of New South Wales, Australia, without regard to its conflict-of-law rules. If a dispute arises between you and InkTwist that we can’t resolve informally, it will be handled exclusively by the courts of New South Wales, Australia, and you and we each consent to the jurisdiction and venue of those courts.

We may update these terms from time to time as InkTwist evolves, for example when we add new features or change how the service works. Whenever the terms change, we’ll update the “Last updated” date at the top of this page. If a change is material, we’ll give you reasonable advance notice before it takes effect, such as a notice in the app or an email to the address associated with your account.

By continuing to use InkTwist after updated terms take effect, you’re accepting the new terms. If you don’t agree with a change, you should stop using the service before it takes effect.
